DATA & CONFIDENTIALITY POLICY
The following policy explains how personal and sensitive information is managed in the context of providing dietetic services through Talia Cecchele Nutrition or TCN Clinic (TC Nutrition Ltd).
Data Protection
The TCN Clinic and all employees comply with current data protection legislation, including the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018.
We are registered with the Information Commissioner’s Office (ICO) and in addition, all practitioners are required to uphold ethical and professional standards set out by The Health and Care Professions Council (HCPC).

Data Collected
To provide dietetic services safely and effectively, we will collect and retain personal information including:

Identity and contact data - name, email address, home address, phone number, emergency contact details, GP practice details

Session data - assessment information, clinical tools, clinical documentation, information shared by other members of the treatment team

Transaction data - records of payments made for services and appointment information (e.g. date and time). We do not automatically collect or store bank account or card details, unless you consent to through the purchase of an appointment package or group package.

You can request any of the information above and if there are an errors, a request to amend the data held can be requested.

Data Storage
All personal information and clinical data is stored in secure GDPR compliant software. Personal information will only be used for the purpose of providing dietetic services and liaising with external health care providers (such as your GP).

Clinical records are retained for eight years from your last contact, as required by law and HCPC Code of Conduct. After eight years from last contact, your records will be destroyed unless you request otherwise.

Confidentiality
Confidentiality is pivotal to establishing trust in a therapeutic relationship. Confidentiality laws are divided by age category:

Young people aged 16 and above have the legal right to confidentiality in their dietetic sessions, meaning they decide what information is shared with their parents/guardians

Children under 16 are assessed using the principle of Gillick Competence. If a child is deemed competent to understand and consent to dietetic sessions, they also have the right to confidentiality.

Clinical records, personal information and history disclosed in consultations will be kept confidential unless:

required by law to be shared or where there are safeguarding risks

in circumstances where it is a part of the dietitian's duty of care to inform the GP, other healthcare providers or family of dietetic/treatment recommendations or risk to self to ensure appropriate support is put in place

if you disclose information which suggests that you may be at risk of harming others

Wherever possible, you will be informed if confidentiality needs to be broken.
